EXECUTIVE ORDER NO. 105

Postsecondary Education Commission

    WHEREAS, The Congress of the United States has recognized
the necessity for studies and planning for the expansion and
improvement of postsecondary education;

    WHEREAS, the younq men and women of the Commonwealth
deserve and require vocational-technical educational programs
and facilities of the highest standards in the area of postsecond-
ary education;

    WHEREAS, the enactment by the Congress of the United States
of Public Law 92-318, the Education Amendments of 1972, pro-
vides for financial support of such studies and planning; and

    WHEREAS, said Public Law 92-318 requires the establishment
of a State Postsecondary Education Commission to conduct such
studies and planning;

    NOW, THEREFORE, I, Francis W. Sargent, Governor of the 
Commonwealth, by virtue of the authority vested in me as Supreme
Executive Magistrate, do hereby order as follows;

    1.  There shall be a Postsecondary Education Commission,
hereinafter called the Commission, which shall, in accordance
with the provisions of Section 1202 of Title XII of the Higher
Education Act of 1965, as amended by Public Law 92-318, be
broadly and equitably representative of the general public and
public and private non-profit and proprietary institutions of
postsecondary education in the Commonwealth includinq community
colleges, junior colleges, postsecondary vocational schools,
area vocational schools, technical institutes, four year institu-
tions of higher education and branches thereof.

    2.  The commission shall be composed of at least fifteen
members, including seven persons, who shall be the persons
appointed by the Governor to the Board of Higher Education,
serving coterminous with their term on the Board of Higher Edu-
cation, and at least eight persons, appointed by the Governor
for terms of one year, who shall be representative of the
general public and public and private nonprofit and proprietary
institutions of postsecondary education in the Commonwealth,
including community colleges, junior colleges, postsecondary
vocational schools, area vocational schools, technical institutes,
four year institutions of higher education and branches thereof.

The membership of the Commission may be increased or decreased
from time to time as may be necessary or convenient to enable
the Commonwealth to receive, for the Commission, any grants or
other funds from the United States.  The Governor shall, from
time to time, designate one member of the Commission to serve as
chairman.  Members shall receive no compensation for their
service but may be reimbursed for expenses necessarily incurred
in rendering such service.  The Commission shall meet at the
call of the chairman and shall meet at least four times a year.

    3.  The Commission shall:

    a)  conduct studies and planning for the expansion and
improvement of postsecondary education in accordance with the
purposes of Sections 1202 and 1203 of Title XII of said Higher
Education Act of 1965, as it may be amended,

    b)  in doing so, establish committees or task forces, not
necessarily consisting of Commission members, and utilize
surveys, submit recommendations, or otherwise contribute the
best available expertise from the institutions, interest groups,
and segments of the society most concerned with a particular
aspect of the Commission's work;

    c)  report to and advise the Secretary of Educational Affairs
with respect to postsecondary education;

    d)  submit, through the Secretary of Educational Affairs, to
the United States Commissioner of Education an annual evaluation
report; and

    e)  take such other actions as may be required by law or
necessary or convenient to fulfill its purposes.

    4.  Subject to the approval of the Secretary of Educational
Affairs, the Commission may, as provided by law, expend such
funds as may be available for its purposes and employ such
professional, technical, and clerical personnel as may be
necessary for the performance of its functions.
